1. Acceptance of Terms

Content you post remains your intellectual property; however, by posting, you grant us a worldwide, royalty-free license to use, display, and distribute that content within the Platform to provide the Services. You warrant you own or have the necessary rights to all content you post.

5. Limitation of Liability

To the fullest extent permitted by law, Ficktoc, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use or inability to use the Platform.

Our total liability for any claim arising under these Terms shall not exceed the amount you have paid to us, if any, in the past six months, or fifty euros (€50), whichever is greater. This limitation applies regardless of the legal theory (contract, tort, etc.).

The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, secure, error-free, or free from harmful components. We are not responsible for the conduct, whether online or offline, of any user of the Platform.

7. Termination

We may suspend or terminate your access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive.
